Terms of Service

These Terms of Service ("Terms") govern your use of the Pet Care Passport mobile application ("the App") provided by Bendaoud Apps ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. Description of Service

Pet Care Passport is a mobile application that allows pet owners to:

  • Create and manage pet profiles
  • Record and track vaccinations and medications
  • Store health-related documents
  • Set reminders for upcoming health tasks
  • Store emergency contact information
  • Share pet information with family members or pet sitters

3. Not a Veterinary Service

Pet Care Passport is not a veterinary service, and does not provide medical advice, diagnosis, or treatment for animals. The App is a record-keeping tool only. Always consult a qualified veterinarian for your pet's health needs. We are not responsible for any decisions you make based on information stored in or displayed by the App.

4. Account Registration

To use the App, you must create an account using a valid email address or Google Sign-In. You are responsible for:

  • Providing accurate account information
  • Maintaining the security of your account credentials
  • All activities that occur under your account

You must be at least 13 years of age to create an account.

5. User Content

You retain ownership of all content you enter into the App, including pet information, documents, and photos ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the App's services to you.

You are solely responsible for the accuracy and legality of your User Content. You agree not to upload content that:

  • Violates any applicable law or regulation
  • Infringes on the intellectual property rights of others
  • Contains malicious software or harmful code

6. Acceptable Use

You agree to use the App only for its intended purpose of managing pet health records. You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App's systems or other users' accounts
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to access the App

7. Availability and Modifications

We strive to keep the App available at all times, but we do not guarantee uninterrupted access. We may:

  • Modify, update, or discontinue features at any time
  • Perform maintenance that may temporarily affect availability
  • Suspend or terminate accounts that violate these Terms

8. Data and Account Deletion

You can delete your account at any time from within the App (Settings > Delete Account). Account deletion permanently removes all your data from our servers, including all pet profiles, health records, documents, and sharing relationships. This action cannot be undone.

9. Intellectual Property

The App, including its design, code, graphics, and branding, is the intellectual property of Bendaoud Apps and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy or completeness of information stored in the App
  • Uninterrupted or error-free operation

11. Limitation of Liability

To the maximum extent permitted by law, Bendaoud Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to:

  • Loss of data
  • Loss of profits or revenue
  • Damages resulting from reliance on information in the App
  • Damages resulting from unauthorized access to your account

12. Indemnification

You agree to indemnify and hold harmless Bendaoud Apps from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bendaoud Apps operates, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. If you disagree with the changes, you should stop using the App and delete your account.
